Terms and Conditions

By accessing or using Geniusko's services, website, or applications (collectively, the 'Services'), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Services.

Geniusko provides AI-powered tools to audit, manage, and optimize Meta (Facebook and Instagram) advertising, together with AI content generation (images, video, and avatars) for use in ads. With your consent, our platform connects to your Meta advertising account to analyze performance and, at your direction, apply changes such as pausing ads or adjusting budgets. With your consent you can also connect your own Google Ads account and, in Kampane, view performance, generate keyword ideas, and after confirmation create or manage the campaigns you authorized. We do not become your manager account and we do not take over billing. With your consent you can also connect TikTok and, in Posts, schedule and publish organic videos to your TikTok account and view their stats. With your consent you can also connect your own Etsy shop so Geniusko can show aggregated daily revenue and order counts from that shop next to your ad results.

By connecting a TikTok account you authorize Geniusko to access your profile, stats and public videos and, at your direction, publish content to your TikTok account. Content you send to TikTok remains yours. You must follow the TikTok Terms of Service and TikTok Community Guidelines. Geniusko does not remove TikTok watermarks or other copyright notices.

Before publishing to TikTok you must confirm TikTok's Music Usage Confirmation. We will not send the post without that confirmation.

You must not use Geniusko for spam, misleading content, or any violation of TikTok's rules. TikTok may restrict posts from an unaudited app to private viewing until our API is approved. You can disconnect TikTok at any time in Integrations.

By connecting YouTube you authorize Geniusko to list your channels and videos and, after you confirm, to upload a video you choose. By using these YouTube features you agree to be bound by the YouTube Terms of Service. The video and text you upload remain yours. We do not change channel settings, comments, or other people's videos. You can disconnect YouTube at any time in Integrations.

With your consent you can connect your own Google Ads account, a Google Analytics property, and a Search Console site. Geniusko reads only the data described in the Privacy Policy. For Google Ads, Geniusko changes a campaign only after you confirm. We do not become your manager account and we do not take over billing. You can disconnect each integration in the app, and you can revoke Geniusko's access in your Google Account.

Geniusko is a first-party service of Zarabaj Online OÜ. When you connect your own Etsy shop, you authorize Geniusko to read that shop and its receipts so we can show you aggregated daily revenue and order counts next to your own advertising results. We do not operate on behalf of a third-party app, we do not scrape Etsy, and we do not use the Etsy API to research other sellers or to train AI models on Etsy catalog content. Support for this integration: info@geniusko.com. You can disconnect Etsy at any time in Integrations.

AND ITS AFFILIATES ARE NOT THE APPLICATION DEVELOPER, DO NOT PROVIDE THE APPLICATION SERVICE, AND MAKE NO WARRANTIES OF ANY KIND WITH RESPECT TO THE APPLICATION OR DATA ACCESSED THROUGH IT.

The term 'Etsy' is a trademark of Etsy, Inc. This application uses the Etsy API but is not endorsed or certified by Etsy, Inc.

To access certain features of our Services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You retain ownership of any content you create, upload, or share through our Services ('User Content'). By submitting User Content, you grant Geniusko a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and display such content for the purpose of providing and improving our Services.

You agree not to submit content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable. We reserve the right to remove any content that violates these terms.

Geniusko and its licensors own all intellectual property rights in the Services, including but not limited to software, designs, algorithms, and documentation. Nothing in these Terms transfers any such rights to you.

Images and avatars generated through our Services are subject to our content policies. While you may use these for personal or commercial purposes in accordance with your subscription plan, Geniusko retains certain rights to the underlying technology and models.

Some features of our Services require a paid subscription. By subscribing to a paid plan, you agree to pay the fees for that plan as they become due. The VAT treatment is specified on the order page before purchase.

If you are a consumer in the European Union, you may withdraw from a payment within 14 days without giving a reason. Write to info@geniusko.com. We cancel the subscription immediately. Access to the features of the app stops at that moment. We then refund the unused part of that payment within 14 days, by the same payment method, at no extra charge.

The unused part is the price you paid multiplied by the share of AI usage still left in that period. AI usage is the percentage shown in your account at the moment we cancel. If AI usage is 20%, we return 80% of the price. If AI usage is 100%, there is nothing left to return. Ad budget is not part of this calculation.

By completing the payment you ask us to open access immediately, during that 14-day period.

If, within 30 days of the payment, you have followed the instructions in the app and you have not seen a benefit, we refund that payment in full. Write to info@geniusko.com. We end the subscription immediately. Access to the features of the app stops at that moment. We return that payment within 14 days, by the same payment method, at no extra charge. This applies to the payment made from that order.

A cancellation stops the next renewal. You keep access to the features of the app until the end of the paid period, and the payment for that period stays as paid.

We may change our fees at any time. We will tell you before a change takes effect.

To withdraw within 14 days, you may send this statement to info@geniusko.com: I withdraw from the contract for Geniusko ordered on [date]. Name, address, email, date. Using the form is optional. A clear statement in an email is enough.

We may suspend or end access if you materially break these Terms, if a payment fails, or if we must do so for security or to comply with the law. Where we can, we tell you first and give you a chance to fix the issue. You may cancel as described in section 6. Ending access does not remove a refund you already have under section 6.

If you are a consumer in the European Union, the app must match what these Terms and the order page describe, and your statutory rights for a digital service remain in force. We do not promise a particular advertising result, uninterrupted operation, or that AI output will be correct. You review content before you publish it. The 30-day refund above is the only result we promise, and only on the conditions written there.

If you buy as a company, the Services are provided as available, and warranties implied by law are excluded to the extent the law allows.

If you buy as a company, to the extent the law allows, we are not liable for lost profits, lost revenue, or indirect damage. Our total liability to that company is limited to the fees it paid us in the 12 months before the claim.

When using conversion-measurement tools (Meta Pixel and the Conversions API), through Geniusko you may send personal data of your visitors and customers to Meta. With respect to this data you are the controller and Geniusko (Zarabaj Online OÜ) acts as a processor that processes the data solely on your instructions. You are responsible for having a lawful basis for the processing and for obtaining from your visitors all legally required consents and providing them with the relevant information (for example a cookie banner and a privacy policy on your website). Geniusko passes the data to Meta as a sub-processor; further sub-processors are listed in the Privacy Policy. We delete the data on request in accordance with the data-deletion page.

These Terms are governed by the laws of the Republic of Estonia.

We may change these Terms. If a change is material, we tell you before it takes effect. If you do not accept it, you may cancel before that date. A change does not remove a right you already have for a payment already made.
